TKO HOME SERVICES LLC

RECURRING PEST CONTROL SERVICE AGREEMENT

(Operating under the licensed brand "Ida Bug Guy")

1. Parties & Brand Disclosure

This agreement is entered into between TKO Home Services LLC ("Company") and the undersigned Client.

TKO Home Services LLC operates under a licensed trade name/brand, "Ida Bug Guy." All services may be marketed, scheduled, or performed under the Ida Bug Guy name; however, all services are provided by and contracted through TKO Home Services LLC, which is the legal entity responsible for service delivery, billing, and fulfillment.

Client acknowledges and agrees that:

  • TKO Home Services LLC is the sole service provider
  • The Ida Bug Guy name is a licensed brand used for marketing and customer recognition
  • Any references to "Ida Bug Guy" represent services fulfilled by TKO Home Services LLC

2. Services Provided

Company agrees to provide general pest control services consisting of four (4) scheduled treatments per year (quarterly), typically between March and December, to maintain ongoing pest protection.

Between scheduled visits, Company may provide limited re-service treatments for covered pests upon reasonable request at no additional charge.

Services do NOT include termites, bed bugs, wildlife, or specialty infestations unless explicitly agreed to in writing.

3. Billing Structure & Payment Authorization

Client agrees to a recurring monthly service fee as listed above. This fee is charged monthly regardless of the timing of service visits and represents a prorated annual service cost.

By signing this agreement, Client authorizes Company to:

  • Store payment information securely
  • Charge the payment method on file for monthly recurring services, initial service fees, approved add-on services, and late fees and applicable charges

If a payment is declined:

  • Client will have thirty (30) days to update payment information
  • A late fee of 3% per month may be applied to outstanding balances
  • Services may be paused or terminated if the account remains unpaid

4. Initial Service & Term

An initial service may be required prior to the start of recurring services and will be billed separately.

This agreement continues on a month-to-month basis and will automatically renew until canceled in accordance with Section 5.

5. Cancellation & Early Termination

Client may cancel services at any time with written notice.

If cancellation occurs within twelve (12) months of the initial service date, Client agrees to pay an early termination fee if required per the contract to account for discounted or front-loaded service costs.

A minimum of three (3) business days is required to process cancellation requests and stop future billing.

Company reserves the right to cancel, refuse, or suspend services at any time.

6. Chargeback & Payment Disputes

Client agrees not to initiate chargebacks or payment disputes for services that have been rendered or charges that are consistent with this agreement.

In the event of a payment dispute or chargeback:

  • Client remains responsible for the full balance due
  • Company reserves the right to pursue collection, including reasonable collection fees, administrative costs, and legal expenses where permitted by law

7. Access to Property

Client authorizes Company to access the property to perform scheduled services.

Service notifications may be provided via text, phone, or email at least 24–48 hours prior to service. If no response is received, Company may proceed with scheduled service.

Client is responsible for:

  • Securing pets
  • Providing access (gates, yards, etc.)
  • Ensuring safe working conditions

If service cannot be completed due to restricted access:

  • The visit may be skipped or rescheduled at Company's discretion
  • Monthly billing will continue uninterrupted

8. Service Limitations

Results may vary due to factors outside Company control, including but not limited to:

  • Sanitation conditions
  • Structural conditions
  • Vegetation and environmental factors
  • Neighboring properties

Certain pest issues may require additional services and fees, including but not limited to rodent control, bird control, or specialty treatments.

9. Liability Disclaimer

Company is not responsible for:

  • Pre-existing infestations
  • Property damage caused by pests
  • Bites, stings, or pest-related health conditions

Client agrees to consult a medical professional regarding any sensitivities or health concerns related to pest control treatments.

10. General Terms

This agreement represents the entire understanding between the parties and supersedes any prior agreements or discussions.

Failure to enforce any provision shall not constitute a waiver of rights.

11. Acknowledgment & Disclosure

By signing up for, purchasing, or using services from TKO Home Services LLC (operating under the licensed brand "Ida Bug Guy"), the Client acknowledges that they have read, understood, and agree to be bound by this Recurring Pest Control Service Agreement in its entirety.

Client understands that:

  • All services are contracted through and provided by TKO Home Services LLC
  • The "Ida Bug Guy" brand is a licensed trade name used for marketing purposes only
  • Recurring billing will be charged automatically per the agreed schedule
  • Cancellation, early termination, and dispute terms are governed by this agreement
  • This agreement may be updated at any time with reasonable notice

This disclosure is provided in accordance with applicable consumer protection laws and regulations. TKO Home Services LLC complies with all federal, state, and local laws governing pest control services, billing practices, and consumer rights in the State of Idaho.
